The Supreme Court in Spain has overruled some of Ryanair’s ‘unfair’ baggage rules where the budget carrier could send luggage on a different flight to their owner.

The legal challenge came following a complaint from a consumer association.

The court ruled that while there could be occasions that would justify sending luggage on a separate flight to the passenger, the airline’s clause was too generic.

The court said: “It leaves to the will of the carrier to send the checked baggage on the same flight as the passenger or not under… unspecified and absolutely unspecific circumstances of safety or operation.”

The Supreme Court also reaffirmed a previous ruling which voided other clauses, including a 40 euro charge for reprinting a boarding pass.
